TERMS AND CONDITIONS FOR THE USE OF LOCKERS


The following Terms and Conditions apply to the use of Lockers owned by the company ANA SOFIA GRANGEIO, UNIPESSOAL, LDA. (hereinafter referred to as "ASG, Unip, LDA."), single registration and tax number 517789175, with registered office at Avenida Rio de Janeiro, nº25H, 1700-331 Lisboa.


By accessing and using the mobile application, as well as the "LOCKER STATION @ALVALADE" facilities and the respective lockers, the USER declares that (i) he/she has read and fully and unreservedly accepts these terms and conditions, which constitute a binding agreement between "LOCKER STATION @ALVALADE" and the USER, (ii) he/she is not prevented by any legal provision or any other reason from being bound by and complying with these terms and conditions.


If you do not agree to these terms and conditions, you must not access or use the mobile application or the services provided therein, and in particular you must refrain from accessing and using the "LOCKER STATION @ALVALADE" facilities and the respective lockers.


The USER is entirely responsible for the use of the application and the services provided therein, for the use of the "LOCKER STATION @ALVALADE" premises and the respective lockers.


These terms and conditions, and any other rules or guidelines relating to the use of the "LOCKER STATION @ALVALADE" facilities and the respective lockers, the configuration of the mobile application or the content and services provided therein, may be amended at any time at the sole discretion of ASG, Unip, LDA. and it is the USER's responsibility to regularly check the updated terms and conditions.


The terms and conditions and subsequent changes shall be deemed effective and binding on USERS once they have been duly publicised on the website www.lockerstationalvalade.pt , or alternatively, in a shorter version which shall be displayed inside the "LOCKER STATION @ALVALADE" premises.


First Clause

(Object)

The present terms and conditions regulate the organisation, use and operation of the "LOCKER STATION @ALVALADE" LOCKERS and respective facilities, via the "Locker Station @Alvalade" application, and apply to all LOCKERS and USERS.


Second Clause

(Lockers)

1. The LOCKERS are exclusively intended for the temporary storage of luggage and/or objects belonging to USERS.

2. The LOCKERS have been designed for autonomous use and the USER must follow the operating instructions available on the mobile application.

3. The LOCKERS are open 24 hours a day, 365 days a year, without prejudice to the fact that they may be closed for reasons of force majeure, which is considered to be any event that jeopardises USERS or deposited objects, or if there is a need to repair the LOCKERS or related equipment.

4. The closure of the LOCKERS under the terms of the previous paragraph will be communicated to USERS as soon as the need is known.


Third Clause

(Time of Use)

1. The USER defines the time of use envisaged for the LOCKERS and authorises the deposit of the amount corresponding to a period of 24 hours of use, until the end of the use of the LOCKER.

2. The value corresponding to the period of time actually used will subsequently be deducted from the captive value under the terms of the preceding paragraph.

3. The maximum value of the deposit will be 24 hours, without prejudice to the possibility of the USER extending the use, which implies a new deposit, for the value corresponding to 24 hours of use, and a new bank authorisation for this purpose, and the provisions of the previous paragraph will also apply.

4. The USER will receive an alert via e-mail and SMS whenever there are 60 minutes and 30 minutes remaining in the 24-hour period of use.

5. Whenever they wish, and at any time, users can select the "Finish" option on the tablet available at the locker facilities, which manages all the compartments, after which they have 20 minutes to remove their luggage from the locker, which will then be their sole responsibility, and the deposit code will no longer be valid.


Fourth Clause

(Time Limit Exceeded)

1. If the time limit for use of the LOCKER, corresponding to 24 hours, is exceeded, without an extension being made under the terms of the previous Clause, in addition to the full amount of the deposit being debited, the luggage deposited will be collected by the entity managing the compartments/room, leaving it in its custody and responsibility, for later return to the rightful owner, up to a maximum of 30 days.

2. For the collection/delivery of luggage, under the terms of the previous paragraph, the USER will be charged a fixed additional fee of €150.00, plus a fee of €25.00 for the safekeeping of luggage, for each day or instalment.

3. After the 30-day period provided for in the paragraph of this Clause has elapsed, without the USER having requested delivery of the luggage or arranged for it to be collected, the luggage shall be considered abandoned for all due purposes, and may be disposed of in any way, namely by being destroyed.


Fifth Clause

(Price)

1. The USER of the LOCKERS undertakes to pay for the use thereof (for the period or instalment actually used) the price set out in the price list available for consultation at the locker premises and/or available on the app, which may be revised from time to time, without any direct notice to each USER.

2. If, for any reason, payment has not been made, ASG, Unip, LDA. reserves the right to prevent the LOCKER from being opened, and may also retain (right of retention) the luggage/goods deposited in the LOCKER, until full payment has been made for the period used and the applicable additional fees.


Sixth Clause

(Prohibited Items)

1. The USER recognises and agrees that any items prohibited or considered dangerous by law, as well as any items that, by their nature, may cause harm to human beings, the environment, or the LOCKERS themselves, may not be deposited in the LOCKERS.

2. For the purposes of the provisions of the previous paragraph, the deposit of the following goods is specifically prohibited:

  1. Live animals and perishable products (e.g. food);
  2. Illegal substances (e.g. narcotics);
  3. Hazardous materials (e.g. weapons, explosives, toxic substances, flammables, acids);
  4. All assets whose deposit could damage or deteriorate the lockers;
  5. Stolen items;
  6. Any other items that could pose a risk to other users, the environment or citizens in general.

Seventh Clause

(General Duties and Obligations of the User)

1. By using the LOCKERS, the USER undertakes, without any limitation, to:

  1. Do not use LOCKERS in violation of any laws, rules, regulations or for illegal or unauthorised purposes;
  2. Use the LOCKERS for the sole purpose of temporarily depositing objects/baggage in a safe place;
  3. Do not place high-value objects inside the LOCKERS, as ASG, Unip, LDA. will not be held responsible in the event of theft or robbery, nor for damage or loss caused by third parties;
  4. Comply with the instructions given by the organisations responsible for the management, security, maintenance, upkeep and cleaning of the LOCKERS;
  5. Use the LOCKERS diligently and, in particular, ensure that they have been properly closed after the USER has deposited or collected the goods/ luggage;
  6. Leave the LOCKER in the same state and condition as assigned to it, and immediately report any incident occurring during the use of the LOCKER;
  7. Not disturbing the use of the LOCKERS by other users in any way, in particular not occupying any area that makes access to and use of the LOCKERS difficult or impossible;
  8. Refrain from lending, renting, selling or transferring the allocated LOCKER to third parties;
  9. Refrain from providing third parties with login details for the application or access codes to the LOCKER;

2. The USER expressly authorises the removal of any goods from the LOCKERS if the maximum period of use has been exceeded or if the deposit has been made in breach of these terms and conditions.

3. The USER authorises ASG, Unip, LDA. and/or any public authority to examine the contents of the LOCKERS in the event of force majeure, danger or strong suspicion of non-compliance with the above rules, and for security reasons.


Eighth Clause

(Security)

1. For the protection of USERS, the "LOCKER STATION @ALVALADE" installations, where the lockers are located, are under permanently active lighting and video surveillance, which is expressly authorised by the USER, with the acceptance of these terms and conditions of use.


Ninth Clause

(Support)

1. The USER has at their disposal a communication system that provides them with support for 2 hours a day, and the respective contact details are displayed inside the installations.


Tenth Clause

(Responsability for Luggage/Objects Deposited)

1. The USER is entirely responsible for the objects placed in the lockers.

2. The ASG, Unip, LDA. is not responsible for the safekeeping of the objects, and is not liable for them in the event of loss, theft or damage, whatever the cause, nor for any potential losses that may arise for the USER.

3. The USER of the LOCKERS is solely and fully responsible for any damage caused to ASG, Unip, LDA. or third parties, arising from the use of the LOCKERS or the objects deposited there.

4. In the event of theft, robbery or loss, the USER must file a complaint with the nearest police station and immediately notify ASG, Unip, LDA. via the email address geral@lockerstation.pt or via mobile phone +351 969529206 within a maximum of 24 hours, attaching a copy of the complaint.

5. The USER assumes responsibility for the cost of repairing or replacing any damaged LOCKER.
