TERMS AND CONDITIONS FOR THE USE OF LOCKERS
The following Terms and Conditions apply to the use of lockers belonging to the company ANA SOFIA GRANGEIO, UNIPESSOAL, LDA. (hereinafter referred to as “ASG, Unip, LDA.”), with the unique registration and tax identification number 517789175, headquartered at Avenida Rio de Janeiro, nº25H, 1700-331 Lisbon.
By accessing and using the mobile application, as well as the “LOCKER STATION @ALVALADE” facilities and their lockers, the USER declares that (i) they have read and fully accept, without reservation, these terms and conditions, which constitute a binding agreement between “LOCKER STATION @ALVALADE” and the USER, (ii) they are not prevented by any legal provision or any other reason from being bound by and complying with these terms and conditions.
If you do not agree to these terms and conditions, you should not access or use the mobile application or the services provided therein, and in particular you should refrain from accessing and using the “LOCKER STATION @ALVALADE” facilities and the respective lockers.
The USER is fully responsible for the use of the application and the services provided therein, for the use of the “LOCKER STATION @ALVALADE” facilities and the respective lockers.
These terms and conditions, as well as any other rules or guidelines relating to the use of the “LOCKER STATION @ALVALADE” facilities and their lockers, the configuration of the mobile application or the content and services provided therein, may be changed at any time at the sole discretion of ASG, Unip, LDA., and it is the USER's responsibility to regularly check the updated terms and conditions.
The terms and conditions and subsequent amendments shall be considered effective and binding on USERS once they have been duly publicised on the website. www.lockerstation.pt, or alternatively, in a shorter version that will be shown inside the “LOCKER STATION @ALVALADE” facilities.
FIRST CLAUSE
(OBJECT)
These terms and conditions govern the organisation, use and operation of the “LOCKER STATION @ALVALADE” LOCKERS and their facilities, through the “Locker Station @Alvalade” application, and apply to all LOCKERS and USERS.
SECOND CLAUSE
(LOCKERS)
- The LOCKERS are intended exclusively for the temporary storage of luggage and/or objects belonging to USERS.
- The LOCKERS are designed for autonomous use and the USER must follow the operating instructions available on the mobile application.
- The LOCKERS are open 24 hours a day, 365 days a year, without prejudice to their closure for reasons of force majeure, which includes any event that puts USERS or deposited items at risk, or if there is a need to repair the LOCKERS or related equipment.
- The closure of CACIFOS under the terms of the previous paragraph shall be communicated to USERS as soon as the need becomes known.
THIRD CLAUSE
(TIME OF USE)
- The USER defines the expected time of use for the LOCKERS and authorises the deposit of the amount corresponding to a 24-hour period of use, until the end of the use of the LOCKER.
- The amount corresponding to the period of time actually used will subsequently be deducted from the amount held in accordance with the previous paragraph.
- The maximum deposit amount will be 24 hours, without prejudice to the possibility of the USER extending the use, which implies a new deposit, for the amount corresponding to 24 hours of use, and a new bank authorisation for this purpose, with the provisions of the previous paragraph also applying.
- The USER will receive an alert via email and SMS whenever there are 60 minutes and 30 minutes remaining until the end of the 24-hour usage period.
- Whenever they wish, and at any time, users can select the “End” option on the tablet available at the locker facilities, which manages all compartments. They then have 20 minutes to remove their luggage from the locker, after which it becomes their sole responsibility and the deposit code is no longer valid.
FOURTH CLAUSE
(TIME LIMIT EXCEEDED)
- If the time limit for use of the CACIFO, corresponding to 24 hours, is exceeded without an extension having been granted under the terms of the previous clause, in addition to the full amount of the deposit being debited, the deposited luggage will be collected by the entity managing the lockers/room, remaining in its custody and responsibility, for subsequent return to the rightful owner, up to a maximum of 30 days.
- For the collection/delivery of luggage, in accordance with the previous paragraph, the USER will be charged an additional fixed fee of €150.00, plus a fee of €25.00 for luggage storage, for each day or fraction thereof.
- Once the 30-day period provided for in this Clause has elapsed, without the USER having requested the delivery of the luggage or arranged for its collection, the luggage will be considered abandoned for all purposes and may be disposed of in any way, including destruction.
FIFTH CLAUSE
(PRICE)
- The USER of the LOCKERS undertakes to pay for their use (for the period or fraction actually used) the price established in the price list available for consultation at the locker facilities and/or available in the application, which may be revised periodically without direct notice to each USER.
- If, for any reason, payment has not been made, ASG, Unip, LDA. reserves the right to prevent the opening of the CACIFO and may also retain (right of retention) the luggage/goods deposited in the CACIFO until full payment of the period used and any additional applicable fees.
SIXTH CLAUSE
(PROHIBITED ITEMS)
- The USER acknowledges and agrees that no items that are prohibited or considered dangerous by law may be stored in the LOCKERS, nor any items that, by their nature, may cause harm to humans, the environment or the LOCKERS themselves.
- For the purposes of the preceding paragraph, the deposit of the following goods is specifically prohibited:
- Live animals and perishable goods (e.g., food);
- Illegal substances (e.g., narcotics);
- Hazardous materials (e.g., weapons, explosives, toxic substances, flammable substances, acids);
- Any items whose storage may damage or deteriorate the lockers;
- Stolen items;
- Any other items that may pose a risk to other users, the environment or the general public.
SEVENTH CLAUSE
(GENERAL DUTIES AND OBLIGATIONS OF THE USER)
- By using CACIFOS, the USER undertakes, without limitation, to:
- Not to use the LOCKERS in violation of any laws, rules, regulations, or for illegal or unauthorised purposes;
- Use the LOCKERS for the sole purpose of temporarily storing objects/luggage in a secure location;
- Do not place valuable items inside the LOCKERS, as ASG, Unip, LDA. will not be liable in the event of theft or robbery, nor for damage or loss caused by third parties;
- Comply with the instructions given by the organisations responsible for the management, security, maintenance, upkeep and cleaning of the LOCKERS;
- Use the LOCKERS diligently and, in particular, ensure that they have been properly locked after the USER has deposited or collected the goods/luggage;
- Leave the CACIFO in the same state and condition in which it was assigned, and immediately report any incident that occurred during the use of the CACIFO;
- Do not interfere with the use of the LOCKERS by other users in any way, namely, do not occupy any area that hinders or prevents access to and use of the LOCKERS;
- Refrain from lending, renting, selling or transferring the CACIFO assigned to third parties;
- Refrain from providing third parties with login details for the application or access codes to CACIFO;
- The USER expressly authorises the removal of any goods from the LOCKERS if the maximum period of use has been exceeded or if the deposit has been made in violation of these terms and conditions.
- The USER authorises ASG, Unip, LDA. and/or any public authority to examine the contents of the LOCKERS in cases of force majeure, danger or strong suspicion of non-compliance with the above rules, and for security reasons.
EIGHTH CLAUSE
(SECURITY)
- For the protection of USERS, the “LOCKER STATION @ALVALADE” facilities, where the lockers are located, are under permanent lighting and video surveillance, which is expressly authorised by the USER upon acceptance of these terms and conditions of use.
NINTH CLAUSE
(SUPPORT)
- The USER has at their disposal a communication system that provides support for 2 hours a day, with the respective contact details displayed within the premises.
TENTH CLAUSE
(RESPONSIBILITY FOR LUGGAGE/DEPOSITED ITEMS)
- The USER is fully responsible for the items placed in the lockers.
- ASG, Unip, LDA. is not responsible for the safekeeping of objects and is not liable in the event of loss, theft or damage, whatever the cause, nor for any potential losses that may arise for the USER.
- The USER of the LOCKERS is solely and entirely responsible for any damage caused to ASG, Unip, LDA. or to third parties, arising from the use of the LOCKERS or the objects stored therein.
- In the event of theft, robbery, or loss, the USER must file a report at the nearest police station and immediately notify ASG, Unip, Lda. via email at geral@lockerstation.pt or by telephone on +351 969529206, within a maximum of 24 hours, attaching a copy of the complaint.
- The USER assumes responsibility for the cost of repairing or replacing any damaged LOCKER.
